Texas Homeschool Requirements

    • Some parents prefer to home-school their children, but may be unsure of the legal and educational requirements. Texas has a simple law for exercising this option.

    History

    • In 1987, the Supreme Court of Texas' ruling in Leeper et al. v Arlington ISD et al. established that children who are being home-schooled are attending a private school and are exempt from compulsory attendance under Texas Education Code Section 25.08(a)(1).

    Requirements

    • The only requirement set by the court and the law is that the parent or guardian supervising the schooling must be acting in a sincere educational effort to meet basic education goals through the curriculum. The court defined the curriculum as written materials that include instruction on reading, spelling, grammar, mathematics and citizenship. School district approval is not required, although schools may inquire about the materials or test scores to be sure that the effort complies with the law.

    Compliance

    • Parents may satisfy the curriculum conditions with materials procured from a private or parochial school or from an educational publisher. They may also use the Texas Essential Knowledge and Skills to develop a plan that meets the requirements.
