How to License a Concession Stand in Boston

One of the major conveniences of city life is the ability to grab a quick bite to eat on just about any corner. Hot dogs, pretzels or a cold drink are usually just a few steps away. For an entrepreneur, a concession stand in a busy city such as Boston can be very lucrative. However, specific regulations must be followed and permits obtained to open a concession stand in Boston.

      Research where you can operate your concession stand; some are prohibited in certain areas. Visit Boston Police headquarters to find out where you can have your stand.

      Complete a vending application from the Boston Department of Public Works if you plan to have your stand in a public area. Apply for a Use of Premises Permit from the Building Division of the Division of Inspectional Services if you will operate on private property. See Resources for links to online applications.

      Get permission from the property owner if you plan to have your concession stand on property that you do not own. The property owner will need to sign the vending application you submit to the Department of Public Works.

      Obtain permission from the individual or business that rents or owns the ground-floor space that directly abuts the proposed location of your concession stand. This individual or their representative also needs to sign the application with the Department of Public Works, granting permission.

      Submit your application to the Department of Public Works. It will be reviewed by Public Works and the Boston Police Department, and approved or denied.

      Secure liability insurance if your application is approved. Massachusetts law requires that all vending operators have liability insurance with the minimum amount of $1 million per occurrence and $2 million in aggregate. You can only obtain this insurance after your license is approved.

      Complete an application for inspection and call the Division of Health Inspections at 617-635-5326 to make an appointment. At inspection, provide the application, a copy of your approval for a vending license and other paperwork as required.

      Apply for a permit from the Boston Fire Department if you plan to use propane or Sterno gas after you receive the permit from the Division of Health Inspections. Return the application to the Boston Fire Department Division of Fire Prevention, with the appropriate fee, to schedule an inspection.

      Present your health and fire permits to the Department of Public Works, along with a photo ID, to pick up your vendor license.
