How to Serve a Bank Levy on Bank of America

A levy is a process device that allows a person or business to collect money owed on a civil court judgment. A levy placed on a Bank of America checking or savings account freezes any money in the account, along with any monies deposited into the checking or savings account. For instance, if you have money in a Bank of America account and have direct deposit, any money being deposited by your employer will be frozen by a levy.

      Sue the debtor in civil or small claims court. Find the appropriate court in which to bring the suit and get a complaint form from the court clerk. Complete the complaint form and file with the court clerk along with the filing fee. Have a process server or sheriff's deputy serve a copy of the complaint on the defendant.

      Allow the defendant's answer period to elapse. Contact the court clerk and schedule a hearing to get a default judgment.

      Apply for a garnishment writ. Take the default judgment to the court clerk's office and request a garnishment writ be issued.

      Phone Bank of America at (954) 473-7710 and ask for the mailing address or fax number. Mail or fax a copy of the garnishment writ to Bank of America. Alternatively, you can have an attorney or process server deliver the garnishment writ to Bank of America.
