Milwaukee City Building Code

Volume 2 of the city of Milwaukee's Building and Zoning Code consists of eight chapters. These regulations cover several topics: a general overview, permits and fees, changes in buildings and structures, occupancy, and zoning uses. Milwaukee's building and zoning code can be accessed and searched online.
  • Department of Neighborhood Services

    • The Milwaukee Department of Neighborhood Services (DNS) was established to protect the "health, safety and welfare" of residents. The agency has power and authority to establish building and zoning code regulations and to enforce provisions of the code.

    Building Code Requirements

    • Ordinance 200-33-5 establishes fees for building permits and services performed by the DNS. Milwaukee's building code supplements all state and federal building code requirements. The strictest regulations are applied. Construction or maintenance of any building or structure that is nonconforming and/or built without a required building permit can be enjoined.

    Functions, Powers and Duties of the DNS

    • Pursuant to the Code of Ordinances (specifically Chapter 200-01(2)), the Commissioner of the DNS has the power to conduct property inspections, issue stop work orders, revoke permits, review plans, and abate nuisances, among other powers and duties.

    Enforcement Powers and Remedies

    • Pursuant to Milwaukee Code of Ordinance, Section 200-01(3)(b) permits the Commissioner of the DNS to enforce provisions of the building and zoning code through all available remedies including forfeiture.
