Montana State Law on Illegal Slot Machines

Casinos with slot machines are located throughout the state of Montana, although all of the casinos are Native American-owned. Other than the slot machines found in approved gambling locations on reservations, slot machines are illegal unless they are a collectible item.
  • Slot Machine Ownership

    • Montana law states that it is illegal for anyone younger than 25 years of age to own a slot machine. Anyone older than 25 who owns a slot machine must be able to prove it is an antique or collectible item. Otherwise, ownership of new slot machines is prohibited except for those used in legal casinos.

    Internet Slot Playing

    • In 2005, the Montana state legislature passed legislation that prohibits gambling on the Internet. This prohibition includes playing online slot machines.

    History

    • In 1950, the Montana Supreme Court ruled slot machines were illegal under the state constitution. In 1984, the court ruled "Draw 80" video poker machines were illegal slot machines.
