How to File a Complaint Against a Notary

Notary Publics are commissioned by states to perform various functions for the public, such as administer oaths, witness signatures, attest to the authenticity of documents and take depositions. Clients who are dissatisfied with the performance of a notary public can file a complaint with the office responsible for the commission. The office will take disciplinary action if it finds the notary at fault.

      Learn the process of filing a complaint against a notary in your state. In most states, such as California and Florida, the Office of the Secretary of State is responsible for commissioning Notary Publics. Call the appropriate office or visit the website for information.

      Obtain the complaint form. If it is necessary to use a complaint form, it may be available for download from the website, or you may be able to pick one up from the office. If forms are not necessary, then you can write a letter.

      Complete the form and include a description of the issue. Attach a copy of the notarized document.

      Submit the form or letter and the supporting document to the appropriate office. The office will examine the issue to determine if the complaint is valid. During this process the office will contact the notary. In some states, like Virginia, the office will schedule an informal hearing where you and the notary can explain the situation. In other states, the office only expects a written statement from the notary. If the office finds that the notary has violated rules, it may suspend or cancel the notary's license.
